RELEASE WAIVER AND INDEMNITY

In consideration of the acceptance of my entry in the event(s) of the Ottawa Race Weekend, including any pre or post race activities, on behalf of myself my heirs, executors, administrators, successors and assigns, I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE, and UNDERTAKE to hold harmless and indemnify against any and all liability incurred by, National Capital Marathon Inc., its directors, sponsors and partners, employees and contributors, and all other associations, sanctioning bodies and sponsoring companies, and all their respective agents, officials, servants, contractors, representatives, elected and appointed officials, successors and assigns from any and all claims, demands, damages, costs, expenses, actions and causes of action, whether in law or equity, in respect of death, injury, loss or damage to my person or property however caused, arising or to arise by reason of my participation in the said event(s), and notwithstanding that same may have been contributed to, or occasioned by, the negligence of any of the aforesaid. In further consideration of the acceptance of my entry in the event(s) of the Ottawa Race Weekend, I ACKNOWLEDGE that returning the timing chip I am provided is my responsibility and if I fail to return same after the completion of the event(s), I ACCEPT to pay the sum of $40. I further ACKNOWLEDGE that my image may be recorded (by video or photograph) during the event(s) and I AGREE to the use of my name, results, age category and my image from the event in any form in broadcasts, newspapers, brochures, promotional material and other media without compensation. By submitting this entry, I ACKNOWLEDGE that I have read, understand and agree to be bound by the terms of this waiver, and that I am signing it voluntarily without duress or undue influence from anyone. I WARRANT that I am physically fit to participate in this event. I also consent to my e-mail address being provided to the officially contracted photography and video/DVD production company(ies) and to the use of the personal information contained in this entry form for the purpose of soliciting by participation in future Ottawa Race Weekend and/or National Capital Marathon Inc. events.

En contrepartie de l’acceptation de mon inscription dans la/les course(s) de la Fin de semaine des courses d’Ottawa, y compris toute activité précédant et suivant la course, en mon propre nom et au nom de mes héritiers, exécuteurs, administrateurs, successeurs et ayant droits, JE, PAR LES PRÉSENTES, LIBÈRE, ABANDONNE TOUTE REVENDICATION ET DÉCHARGE POUR TOUJOURS, et JE M’ENGAGE à tenir francs de tout préjudice et à indemniser contre toute obligation encourue par eux, la société National Capital Marathon Inc., ses directeurs, ses commanditaires et partenaires, ses employés et collaborateurs, et tous autres associations, organismes exerçant sanction et sociétés commanditaires, et tous leurs agents, officiels, serviteurs, contractants, représentants, élus et nommés, successeurs et ayant droits respectifs, de toute réclamation, de toute demande, de tous dommages, coûts, dépenses, actions et causes d’action, en droit ou en équité, en matière de mort, blessure, perte ou dommage à ma personne ou ma propriété quelle qu’en soit la cause, découlant ou à découler de ma participation à ladite/auxdites course(s) et nonobstant le fait que les mêmes préjudices puissent avoir été en partie ou en tout occasionnées par, la négligence de n’importe lequel des susdits. En considération supplémentaire de l’acceptation de mon inscription dans la/les course(s) de la Fin de semaine des courses, JE RECONNAIS qu’il est de ma responsabilité de retourner le chronomètre à puce qui m’est fourni, faute de quoi, après la fin de la/des course(s), J’ACCEPTE de payer la somme de 40 $. JE RECONNAIS de plus que mon image peut être enregistrée (par vidéo ou photographie) pendant la/les course(s) et J’ACCEPTE l’utilisation sans compensation de mon nom, de mes résultats, de ma catégorie d’âge et de mon image de la course sous toute forme dans des émissions, des journaux, des brochures, du matériel de promotion et autres médias. En soumettant cette inscription, JE RECONNAIS que j’ai lu, que je comprends et que j’accepte d’être lié(e) par les termes de cette renonciation, et que je la signe de mon plein gré, sans contrainte ou influence indue de quiconque. JE GARANTIS que je suis physiquement apte à participer à cette course. Je consens aussi à ce que mon adresse de courriel soit fournie à la/aux compagnie(s) de production officiellement chargées à contrat de la photographie et de la production de vidéo/DVD, et à l'usage de mes renseignements personnels contenus sur ce formulaire d’inscription aux fins de solliciter ma participation dans de futures courses organisées par la Fin de semaine des courses d’Ottawa et/ou National Capital Marathon Inc. Je comprend également que les inscriptions sont non-remboursables et non-transférables.
